Maximum Security Owners Taking Derby Appeal To Federal Court

LOUISVILLE, Ky. -- The Derby disqualification case is going to federal court.

Gary West tells Fox News he'll file the lawsuit in the appropriate jurisdiction to appeal the decision of the Churchill Downs stewards to disqualify his horse from the Derby. His decision comes a day after the Kentucky Horse Racing Commission denied his appeal of the stewards ruling on the grounds that state racing rules don't allow for an appeal of a stewards decision.

Maximum Security won Saturday's race, but second-place Country House was the beneficiary winner after the disqualification.

West blames War of Will, which ran from the number two post, for causing the problems behind Maximum Security.
